Probe continues in Amtrak fatal accident in Cary

— Police are continuing to investigate the fatal collision of an Amtrak train with a car last week and have not charged the car’s driver, who survived.

Benny Derrick Dimery could face charges after witnesses told police he drove around the railroad crossing arms at Southwest Maynard Road as Amtrak’s Silver Star approached just before 11:30 a.m. Thursday. Dimery’s girlfriend, Lauren Webb, 21, was killed when the train hit the passenger side of the Mitsubishi Gallant that Dimery was driving.

The train was going 55 to 57 mph when it hit the car, police said.

Dimery, 24, was listed in good condition Tuesday at WakeMed in Raleigh.

Police expect to complete their investigation by the end of the week, Cary spokeswoman Deanna Boone said.
