Cary might tweak land-use rules
Daycares, front-yard parking and strip clubs could be affected

CARY - The Town Council is considering more tweaks to its long list of land-use regulations.

The latest round of proposed changes amount to the 13th revision since 2003, when Cary's leaders last made a sweeping overhaul of land development ordinances.

Up for discussion are amendments that would tighten regulations on daycare, parking and strip clubs.

A public hearing on the proposed amendments has been scheduled for Oct. 22. The changes could include:

Reducing the number of children allowed in small daycare homes from eight to five.

Cary also could lower the threshold for requiring home-based day cares to acquire a special use permit based on the number of children allowed in a large daycare home.

Cary currently requires that a larger daycare apply for a special use permit when keeping nine or more children in the home. The new rules would mandate a special use permit if a daycare home serves six or more children.

Existing daycare homes would be allowed to continue operating under the current rules as long as they remain in good standing with the N.C. Department of Health and Human Services, which licenses child care facilities.

The proposed change was sparked by complaints about congestion and noise generated by small day care homes.

Placing limits on parking in the front yard of residential lots. The Town Council began exploring a revision of parking regulations after residents worried that the practice could impact property values and cause runoff problems. New rules would limit parking in front yards of single-family and duplex lots to no more than 40 percent of the yard.

Restricting "sexually-oriented businesses" to a single zoning district. If approved, massage parlors, adult video shops and strip clubs would be prevented from operating outside of Cary's industrial zones.

Adult businesses would not be allowed within 2,000 feet of each other or within 1,000 feet of any church, school, daycare center, public park, house or residential zone. The change was proposed to address worries about how such businesses could impact property values.
